PUBLIX AT SEASON'S PEAK APPLES RECIPE CONTEST OFFICIAL RULES

  1. NO PURCHASE IS NECESSARY TO ENTER OR WIN.
  2. The Publix At Season's Peak Apples Recipe Contest is sponsored by Publix Super Markets, Inc. ("Publix") and Meredith Corporation (collectively "Sponsors"). The geographic scope of this promotion is Florida, Georgia, Alabama, Tennessee, and South Carolina.
  3. Contest is subject to all U.S. federal, state and local laws.  Void where prohibited by law.  By entering, entrants agree to these Official Rules and to the decisions of the judges, which are final and binding in all respects. Multiple entries may be submitted from one person but each entry must be for a separate and unique recipe. Limit one (1) prize per person.
  4. Contest begins on October 22, 2009 at 12:01 a.m. Eastern Time (“ET”), and ends on December 2, 2009 at 11:59 p.m. ET. Final entry deadline is December 2, 2009 at 11:59 p.m. ET. Judging to determine Winners will be held on or about December 31, 2009.
  5. ELIGIBILITY

  6. All entrants must be twenty-one (21) years old and legal residents of Florida, Georgia, Alabama, Tennessee, or South Carolina at the time of entry.
  7. Employees of Sponsors and their affiliates, subsidiaries, distributors, suppliers, franchisees, advertisers, promoters, and agents, and the immediate families (defined as spouse, parents, siblings or children) or household members (whether or not related) of the employees of any of these, are not eligible to enter or win.
  8. PRIZES

  9. One (1) Grand Prize Winner will win: Fifty-two (52) $100 Publix Super Market gift cards. Approximate Retail Value ("ARV") of Grand Prize is $5,200.00.
  10. Three (3) Runner-Up Prize Winners will each win: A $100 Publix Super Market gift card. ARV of each Runner-Up Prize is $100.00.
  11. PRIZE RESTRICTIONS

  12. All details of all prizes shall be at Sponsors’ sole discretion. Winners assume sole responsibility for all costs associated with the prizes not explicitly outlined above. All U.S. federal, state and local taxes (if any) are the sole responsibility of the winners.
  13. Gift cards are subject to issuer restrictions, may not be redeemed for cash and may not be used to purchase gift cards, money orders, alcohol or tobacco. Prizes may not be sold, bartered or auctioned. Prizes may not be transferred or substituted except that Sponsors in their discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.
  14. Any portion of any prize not used by any winner is forfeited and no cash substitute will be offered or permitted. All prizes being offered are provided "as is" with no warranty or guarantee either express or implied by Sponsors. Merchandise prizes carry no warranty other than that offered by manufacturers. Sponsors have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any Prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Other restrictions apply.
  15. TO ENTER

  16. Entries will be accepted beginning October 22, 2009 at 12:01 a.m. ET and ending December 2, 2009 at 11:59 p.m. ET ("Entry Period").
  17. First, create an original recipe using apples. In order to be eligible, your recipe must be your own original work. Entrants represent that recipes submitted are their original and unpublished works. Multiple entries are allowed from one entrant, but each recipe must be submitted as a separate entry and only one (1) entry per submission will be accepted.
  18. Each entry must meet the following requirements: (a) use at least 3-4 apples (b) include recipe name and the number of servings that the recipe yields; (c) use ingredients that are available in most grocery stores; (d) list exact ingredients with measurements in order of use and in standard U.S. measurements; (e) include step-by-step preparation and cooking directions; (f) include: entrant name and complete address with zip code, telephone number with area code.
  19. By entering this Contest, entrants agree to assign their intellectual property rights to Publix and permit Publix to use the recipes in any media, including on the Internet, for commercial, editorial, or any other purpose whatsoever. Entrants who do not agree to this use should not enter this Contest.
  20. Second, submit your entry. There are two ways to submit your recipe entry.
    1. Online: Visit publix.com/atseasonspeak and submit your original recipe on the Official Entry Form completed with the following required information: (a) name, (b) address, (c) telephone number, including area code; or
    2. Mail: Hand-print legibly or type your recipe on a sheet of paper or index card, along with the following information on the same page or card: (i) name, (ii) address, (iii) telephone number, including area code and mail it to: Publix At Season’s Peak Apples Recipe Contest, c/o Meredith Corporation, 1716 Locust St., LN 318, Des Moines, IA 50309–3023.
  21. Online entrants will see a web page confirming the entry after submission. In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at time of entry. “Authorized Account Holder” is defined as the natural person 21 years of age or older who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The use of automated entry systems or any other conduct that impedes the integrity of the contest is prohibited.
  22. To be eligible for the Contest, online entries must be received by Sponsors no later than 11:59 p.m. ET on December 2, 2009. All mail-in entries must be postmarked on or before December 2, 2009 and received by Sponsors no later than December 7, 2009. Proof of mailing is not considered proof of delivery or receipt. Entrants who fail to provide any of the information required above will not be eligible to win and will not be notified by Sponsors. All entries become the property of Publix and will not be returned or acknowledged.
  23. If you enter the Contest online, the information that you provide in connection with the Contest may be used by Publix in accordance with its Privacy Policy, which is found at www.publix.com/PrivacyPolicy.do and which may be updated from time to time.
  24. JUDGING AND WINNER SELECTION

  25. All entries will be judged by a panel of Meredith Corporation's Test Kitchen staff. Specific judges are subject to change in Sponsors' discretion. You need not be present to win.
  26. There will be two rounds of judging. The first round of judging will be conducted on or about December 7, 2009, or within a reasonable time thereafter. During this round, the recipe ingredients and preparation instructions will be judged on the basis of originality (50%) and use of product (50%). Sponsors reserve the right to select fewer than eight (8) Finalists if, in their sole discretion, they do not receive a sufficient number of qualified entries. Subject to verification of eligibility, the entrants with the top eight (8) recipes will be declared Finalists. In the event of a tie, the entrant with the highest score in the category of originality will be declared a Finalist.
  27. The second round of judging will be conducted on or about December 29, 2009, at which time the recipes of the Finalists will be prepared and judged by a panel of Meredith Corporation's Test Kitchen staff and judged on the basis of taste (40%), use of apples (40%) and ease of preparation (20%). Subject to verification of eligibility, the Finalist whose recipe earns the highest overall score will be declared the Grand Prize Winner and the three (3) Finalists with the next highest scores will be declared Runner-Up Winners. In the event of a tie, the Finalist whose recipe earns the highest score in the category of taste will be declared a winner.
  28. Sponsors reserve the right to select fewer than four (4) winners if, in their sole discretion, they do not receive a sufficient number of qualified entries. Decisions of judges are final and binding in all respects.
  29. WINNER NOTIFICATION

  30. Sponsors will contact all potential winners in accordance with the contact information supplied to Sponsors. Winners may be asked to provide Sponsors with valid identification and execute an Affidavit of Eligibility/Ownership/Liability Release, Publicity Release (except for Tennessee residents) and an Assignment of Pre-existing Work, all within ten (10) days of notification. Acceptable identification includes a valid driver’s license or other valid picture ID showing name and address. Faxes will not be accepted. The winners may also be required to sign other legal documents, including tax forms. Grand Prize Winner will be issued a MISC-1099 tax form in the amount of the Grand Prize value as stated herein. Upon verification of eligibility, the names of winners may be posted on the Publix website at publix.com/atseasonspeak. Prizes will be delivered within approximately thirty (30) days after verification of winners.
  31. In the event that any potential winner (a) fails to satisfy any eligibility or verification requirement herein, (b) declines to accept the prize, or (c) is otherwise determined to be ineligible, Sponsors may in their discretion disqualify that individual and the Finalist with the next highest score will be declared an alternate winner. Alternate winners are subject to all eligibility requirements and restrictions of these Official Rules.
  32. PUBLICITY RELEASE

  33. By accepting a prize, winners agree to award Publix the right to publicize their names, recipes, photographs (including the use and appearance of winner's photograph on Publix’s web page), likenesses, biographical information, voices and details of winning for purposes of this and future promotions without further compensation, except where prohibited by law and in Tennessee.
  34. MISCELLANEOUS

  35. All U.S. federal, state and local laws apply.  Sponsors shall be entitled to interpret these rules as needed — including but not limited to rules regarding entries, selection of winners, deadlines, restrictions on prizes, and eligibility — and all of their decisions are final.  By entering, entrants agree to these Official Rules.
  36. Sponsors reserve the right to cancel, terminate or suspend this Contest or any part of this Contest should any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or other causes beyond their control, corrupt or impair the security, administration, fairness and/or operation of this Contest as determined by Sponsors in their sole discretion, at which time, Sponsors will determine the winners from among all non-suspect entries received at the time of the Contest termination using the same selection method and criteria set forth above.
  37. Sponsors reserve the right to prohibit any entrant from participating in the Contest if, at their sole discretion, Sponsors find such entrant to be tampering with the entry process or the operation of the Contest, or if such entrant repeatedly shows a disregard for, or attempts to circumvent, these Rules, or acts: (a) in a manner Sponsors determine to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or Sponsors; or (c) in any other disruptive manner. Any person attempting to defraud or tamper with this Contest in any way will be ineligible for prizes and may be prosecuted to the full extent of the law. Any failure by the Sponsors to enforce any of these Rules shall not constitute a waiver of such Rules.
  38. Sponsors reserve the right to correct printing, typographical or clerical errors in any contest-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsors reserve the right to award only the stated number of prizes by selecting the Winners from all legitimate, un-awarded, eligible prize claims in accordance with the previously announced selection criteria.
  39. LIMITATION OF LIABILITY/DISCLAIMER OF LIABILITY

  40. Entrants agree that Sponsors, and a range of subsidiaries, directors, agents, agencies, affiliates, franchisees, promoters, officers, directors, employees and related persons (a) are not responsible for lost, interrupted, or unavailable network, server, or other connections, or for any failed telephone or computer hardware or software, or for any lost, misdirected, illegible, stolen, or incomplete Entry Forms, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for entries that for any reason are not received by Sponsors by the deadlines stated above; (b) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in this contest or downloading of any software or materials; (c) are released from any and all liability related to this Contest and the receipt and use of any prize; and (d) will not be responsible for the inability to select winners because of equipment failure or data storage failure.
  41. By entering the Contest, entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
  42. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsors in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Florida. Any legal proceedings arising out of this Contest or relating to these rules shall be instituted only in the federal or state courts located in the State of Florida, County of Polk and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
